SOTG Job Applicant Privacy Notice

 Effective Date: January 1, 2023

Your Privacy is important to Seaboard Overseas and Trading Group (“We,” “Our,” “Us,” or “SOTG”). We developed this Job Applicant Privacy Notice (“Notice”) to provide you with information concerning our personal data collection and usage, as well as our privacy and security practices, when you apply for a job with SOTG. This Notice does not apply to or address our general employee or website privacy practices.

For the purposes of this Notice:

Personal Data” means any information relating to an identified or identifiable natural person.

Processing” means any operation, whether passive or active, such as collection, storage, use, disclosure, adaption, or destruction.

You” and “Your” refers to any person reading this Notice who is applying for an employment position with SOTG.

Categories of Personal Data we Process

We will process the following categories of data when you apply for an employment position with SOTG:

  • Personal Data that is Processed when you Submit Information into our Job Application Database. When you submit information into our job application database(s), we collect your Personal Data including your name, address, email, phone number, and various other resume-related datasets (i.e., education background, past employment positions.)
    • Purpose and Legal Ground: We process this Personal Data to 1) provide you with an efficient avenue to apply for an employment position with SOTG and 2) analyze and process your employment application. The legal ground for the processing of your Personal Data for this purpose is our legitimate interest in processing your employment application.
  • Personal Data that is Processed when you Sign Up for our Vacancy Alert E-mail Service. When you sign up for our vacancy alert e-mail service, we will collect your Personal Data including your e-mail address, name, and other unique identifiers.
    • Purpose and Legal Ground: We process this Personal Data to provide you with the details of employment vacancies which match your selected criteria. The legal ground for the processing of your Personal Data for this purpose is your specific and informed opt-in consent which you may withdraw at any point by emailing us at [email protected].

Retention of Personal Data

If your application is unsuccessful or you choose not to accept any offer of employment made by SOTG, your Personal Data will not be held longer than necessary for the purpose it was originally collected, after which time it will be destroyed. However, relevant information will be retained longer for the purpose of facilitating our equal opportunities monitoring and other legal obligations.

If your application is successful, your Personal Data will form part of your employment file for the purpose of creating your employment contract and maintaining your employment status with SOTG.

If you are an employment applicant from the European Economic Area (“EEA”), U.K., Isle of Man or any other country that provides data subjects with the right to delete Personal Data upon request, please see the “Personal Data Rights” section below for more information on the general right of erasure.

Protecting Your Personal Data

We implement technical and organizational security measures that are designed to assist in maintaining proper security and confidentiality of your Personal Data. For example, we implement company-wide access controls to minimize unnecessary employee access to Personal Data.

Personal Data Rights

If you reside in the EEA, U.K., or the Isle of Man, you have the right, subject to the conditions set out in the General Data Protection Regulation (“GDPR“) or other applicable law(s), to request from SOTG 1) access to and rectification or erasure of your personal data, 2) data portability, 3) restriction of processing of your personal data, 4) the right to object to processing of your personal data, and 5) the right to lodge a complaint with a supervisory authority. If you are located outside of the EEA, U.K., or the Isle of Man, you may have privacy rights that you may seek to exercise under your local laws.

Exercising your Personal Data Rights

Disclosure of your Personal Data

To Third-Party Service Providers. When you apply for a position with SOTG, we may transfer your Personal Data to third-party service providers to assist us in processing your job application. Additionally, if you accept an employment position with SOTG, we may disclose your Personal Data to third-party service vendors as necessary to administer payroll and benefits to you directly and create and maintain your employment profile as a result of our employment contract with you.

Within Our Corporate Family. We may disclose your Personal Data to companies within our corporate family when there is a necessary benefit to you and/or SOTG.

For Certain Business Transactions. We may disclose your Personal Data in relation to a merger, acquisition, or a reallocation or liquidation of all, or a portion of, our business assets.

For Legal Obligations and Emergency Disclosures. We may disclose your Personal Data when we, in good faith, believe that we are compelled to disclose such Personal Data by applicable law(s) or regulation, a request from a competent court of authority, or where we find it necessary to exercise, establish, or defend our legal rights. We may also disclose your Personal Data when seeking to respond to an emergency in which we believe the necessary disclosures will prevent harm to you and/or SOTG employees and customers.

Children’s Privacy

SOTG employment applications are not directed to individuals under the age of 18. We do not process Personal Data submitted through our applications from individuals under the age of 18 for any purposes. If we learn that we have collected Personal Data directly from someone under the age of 18, we will take the necessary steps to delete such Personal Data.

Automated Decision Making

SOTG does not make any decisions based on algorithms or other automated processing that significantly affects you.

Privacy Notice Updates

We may update this Notice from time to time as we change our applicant processes or if we change our general data protection and information governance policies. The date this Notice became effective is listed at the top of the Notice. If we make any material changes to the way that we handle your Personal Data, we will notify you by email within 60 days.
